Information for the GOLDORAK distributors and buyers
At present, DECLIC IMAGES and MANGA DISTRIBUTION phone the distributors and send them faxes pretending that the 5 october, 2005 référé decision of the Court of Paris authorizes them to sell the GOLDORAK DVD.
This procedure was limited to the counterfeiting of our GOLDORAK trademark and did not examine the issue of our copyright on the animated series and the counterfeiting of our products.
We have brought an action against MANGA DISTRIBUTION and DECLIC IMAGES to the Court of Paris for counterfeiting, unfair competition and parasitism. The Court will examine the case on October 28.
We remind you that we own the GOLDORAK trademark, which was renewed in 1999 for classes 9, 16, 22, 24, 25, 28, 38, 39 and 41 and that we also are the owners of the copyright and the reproduction rights of the animation series duly registered with the Japanese Ministry of Cultural Affairs and the producers association.
DYNAMIC PLANNING, owner of the rights of the author of the comics, M. Go NAGAÏ, supports us in our actions.
The DVDs of MANGA DISTRIBUTION and DECLIC IMAGES are servile copies of the DVD that we distributed ourselves in Japan in 2004.
We want to thank the French administration, particularly the French Customs which decided to officially seize themselves of this case on September 26, as well as the Regional Direction of Consumption, Competition and Repression of Fraud which continues to investigate this case that should, in all logic, be sent to the Public Prosecutor for criminal proceedings.
We have started about twenty new legal actions in France, Belgium, Luxembourg and Switzerland against distributors that sell the counterfeited DVDs. Others will soon follow. We are confident in French justice.
We are determined to make an example out of this case to ensure that anyone, in Europe, knows that we will not tolerate any illegal use of our rights.

In sintesi............va bene fare la VOCE GROSSA , pero'
si trovi una soluzione a questo LIMBO (per francesi e
ITALIANI) senno' dopo gli APPASSIONATI , quelli che fanno girare miliardi di euro (non posso mettermi certo a elencare tutte le valute del mondo...........) all anno per il materiale correlato alle serie , e' NORMALE che si affidano al mercato "nero"

Before the Court of Paris on November 28, 2005, MANGA DISTRIBUTION and DECLIC IMAGES which have duplicated and released GOLDORAK DVD without any rights, have been condemned to pay a total amount of 7.2 millions of euros for damages on the ground of counterfeiting and unfair competition. The Court of Paris has also ordered the prohibition and the withdrawal for destruction of the counterfeiting DVD and the publication of the judgement in three newspapers. The Court has decided that the Judgement shall be immediately executed and for a half for the damages.
